These Terms govern the use of the Hello Romy platform ("the platform", "the service") provided by Melbourne Travel Project Pty Ltd (ABN 63 635 946 093), an Australian company ("we", "us", "our"). By subscribing to or using the platform, you agree to these Terms.
Hello Romy is a software platform designed to help licensed travel agencies operate more efficiently and serve their clients better. We provide the software. Subscribing agencies use it to manage their own client communications, bookings and operational workflows.
Hello Romy is not a travel agency, does not sell travel, and does not hold travel bookings on behalf of consumers.
The platform is intended for licensed travel agencies and their authorised staff. By subscribing, you confirm you are authorised to enter into this agreement on behalf of your business and that your business holds any licences required to operate as a travel agency in your jurisdiction.
Hello Romy is sold by subscription. Pricing tiers, included features and onboarding terms are confirmed during the demo and onboarding process. Subscriptions are billed on a recurring basis and auto-renew unless cancelled in accordance with the cancellation terms agreed at onboarding.
Hello Romy supports messaging via WhatsApp Business and other channels. Use of these channels is conditional on the following:
Breach of these conditions may result in immediate suspension of the relevant messaging channel or of the platform overall.
When using Hello Romy you also agree:
We may suspend or terminate access for breach of these conditions.
You are responsible for the accuracy, lawfulness and consent basis of any personal information you submit to the platform, including obtaining the necessary consents from your clients to be contacted via the platform and to have their information processed within it.
Our handling of personal information is described in our Privacy Policy.
We aim to keep the platform available and reliable but do not guarantee uninterrupted access. From time to time we may need to perform maintenance, change features, or rely on third-party services whose availability is outside our control. We will give reasonable notice of significant planned changes.
The platform, including all software, branding, written materials and design elements, is owned by Melbourne Travel Project Pty Ltd or licensed to us. Subscribing agencies are granted a limited, non-exclusive, non-transferable right to use the platform for the term of their subscription. Nothing in these Terms transfers ownership of any intellectual property to subscribers.
"HELLO ROMY" is a trademark of Melbourne Travel Project Pty Ltd.
Subscription fees are payable in advance for each billing period. If a payment fails, we may suspend access until the account is brought current. Other than where required by law, fees are non-refundable.
Either party may terminate the subscription at the end of a billing period in accordance with the cancellation terms agreed at onboarding. We may terminate or suspend the platform immediately for serious breach of these Terms, fraudulent activity, or where required by law.
The platform is provided on an "as is" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms excludes any rights you have under the Australian Consumer Law that cannot be lawfully excluded.
To the maximum extent permitted by law, our aggregate liability arising out of or in connection with the platform is limited to the fees paid by you to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential or special damages, including loss of profits or business interruption.
You agree to indemnify and hold us harmless from claims, damages or losses arising out of: (a) your use of the platform in breach of these Terms, (b) personal information you submit to the platform, or (c) communications you send to your clients via the platform.
These Terms are governed by the laws of Victoria, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of Victoria.
We may update these Terms from time to time. Material changes will be notified to subscribing agencies via the email associated with their account, with at least 30 days' notice before they take effect. Continued use of the service after the notice period constitutes acceptance.
